Information on the Controlled Substance Prescribing CMEs provided by FOMA:

The FMA has provided new information that has recently come to their attention regarding MDs who completed the controlled substance prescribing course offered by FOMA. The Florida Department of Health (DOH) and CE Broker are treating the 2/1/2017 to 1/31/2019 MD renewal group differently than the 2/1/2018 to 1/31/2020 MD renewal group. These are the two scenarios:

MDs whose licenses renew/expire on 1/31/2019:

  • An MD whose license renews/expires on 1/31/19 and takes or has taken the FOMA approved Controlled Substance Prescribing course any time after the course was approved by the FL Board of Medicine through 1/31/2019, it will count toward the Controlled Substance Prescribing requirement, but it will NOT count toward the 40 hours of CME MDs are required to complete every two years.  This is because the Controlled Substance Prescribing course is NOT listed as a requirement on the “transcript” for the 2/1/2017 – 1/31/2019 MD renewal term and the FL Board of Medicine does not recognize AOA credit. If the same physician would have taken a FL Board of Medicine-approved Controlled Substance Prescribing course approved for AMA PRA Category 1 CreditTM, then CE Broker would be able to count those two hours toward their general hours. 

  • Once this group of renewers gets to the 1/31/2021 renewal, it won’t matter if the Controlled Substance Prescribing course was approved for AMA or AOA credit because it will be listed as requirement on the MD transcript for this renewal period (2/1/2019-1/31/2021) and will thus count toward the total number of CME hours required by law for renewal. 

MDs whose licenses renew/expire on 1/31/2020:

  • If an MD whose license expires on 1/31/2020 takes the FOMA Controlled Substance Prescribing course any time after the course was approved by the FL Board of Medicine through 1/31/2020, it will count toward both the Controlled Substance Prescribing requirement and toward the 40 hours of CME MDs are required to complete every two years.  This is because the Controlled Substance Prescribing course is or will be listed as a requirement on the “transcript” for the 2/1/2018 – 1/31/2020 MD renewal term. Because it will be listed as a requirement on the transcript and the Board of Medicine has approved the FOMA course, it doesn’t matter whether the course is approved for AMA or AOA credit. 

The FMA has brought this discrepancy to the attention of both DOH and CE Broker personnel but at this point, it does not seem they are planning to change. CFMSE recommends that medical societies who have provided the FOMA course to any MDs with licenses renewing 1/31/19 alert those physicians that the course will fulfill their statutory obligation for the 2-hour controlled substances course but appears not to apply to their 40-hour CME requirement.
